Shop Terms and Conditions

Effective from 18 October 2026. This translation is provided for information only – the Polish version of the Terms and Conditions is legally binding.

§ 1. General provisions

  1. The online shop available at zrodelko.pl (the Shop) is run by TAKO B. Caba, K. Majewska Spółka Jawna, registered office: Siedliszowice 84, 42-425 Kroczyce, Poland, NIP (tax ID) 6291002170, KRS 0000077814 (the Seller).
  2. Contact with the Seller: e-mail: zrodelkotako@gmail.com, phone +48 533 147 599, correspondence address: Siedliszowice 84, 42-425 Kroczyce, Poland.
  3. These Terms set out the rules for placing orders, payment, delivery, complaints and withdrawal from the contract. The Terms are available free of charge on the Shop website in a form that allows them to be downloaded and printed.
  4. To use the Shop you need a device with internet access, an up-to-date web browser with cookies and JavaScript enabled, and an active e-mail address.
  5. The Customer is prohibited from providing content of an unlawful nature.

§ 2. Definitions

  1. Customer – a natural person, legal person or organisational unit without legal personality that places an order in the Shop.
  2. Consumer – a natural person concluding a legal transaction with the Seller that is not directly related to their business or professional activity.
  3. Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, where the content of the contract shows that it is not of a professional nature for them (Art. 38a of the Polish Consumer Rights Act).
  4. Product – Ostaniec spring water in a gallon bottle (18.5 l of water in a 18.9 l bottle) and other goods offered in the Shop.
  5. Bottle – a reusable gallon bottle in which the water is delivered.

§ 3. The Shop’s offer

  1. First purchase with courier delivery – sale of water in a Bottle with courier delivery within Poland. The Bottle becomes the Customer’s property and is not returned.
  2. Bottle exchange by courier – sale of water in a full Bottle in exchange for the Customer returning an empty Ostaniec Bottle. The full Bottle is delivered by Pocztex (to the given address or to a chosen pickup point), and the empty Bottle is collected by a DPD courier or dropped off by the Customer at a Żabka point, using a return label sent by the Seller. Detailed rules for preparing the return parcel are described on the Bottle exchange page.
  3. Packages delivered by the Seller’s own transport – sale of water in packages of 4 to 16 Bottles delivered by the Seller’s own transport in selected towns of the Silesian Voivodeship and their surroundings, listed on the Delivery in Silesia page. The package price depends on the delivery location. On delivery the driver collects the empty Ostaniec Bottles.
  4. If a Customer using the packages does not hand the driver as many empty Bottles as the number of full Bottles delivered, they pay a fee for each missing Bottle: PLN 25 gross added to the order when it is placed, or PLN 30 gross paid to the driver on delivery, as chosen in the order form. A Bottle for which the fee has been paid becomes the Customer’s property.
  5. An empty Bottle returned as part of the exchange should be undamaged and come from the Seller (an Ostaniec Bottle).

§ 4. Prices

  1. Prices in the Shop are gross prices, include VAT and are given in Polish złoty (PLN).
  2. Prices of Products in the “First purchase” and “Bottle exchange by courier” offers include the cost of delivery. Package prices include delivery by the Seller’s transport.
  3. The binding price is the one shown in the order summary at the moment the order is placed, including any fee for missing Bottles.

§ 5. Placing orders

  1. Orders are accepted through the order form in the Shop 24 hours a day. Orders for packages and questions can also be placed by phone or text message at +48 533 147 599.
  2. To place an order, the Customer adds a Product to the cart, provides delivery and contact details (including a phone number), answers the questions about returning empty Bottles, accepts the Terms and chooses a payment method.
  3. Placing an order constitutes an offer to conclude a sales contract. The Seller confirms acceptance of the order by e-mail, at which point the contract is concluded.
  4. The Seller may contact the Customer by phone to agree the delivery date or details of collecting the empty Bottles.

§ 6. Payments

  1. Available payment methods: online payment via the Tpay service (including BLIK, fast bank transfer, payment card) and – for packages delivered by the Seller’s transport, by arrangement – other methods indicated in the order form.
  2. Online payments are handled by Krajowy Integrator Płatności S.A., based in Poznań (operator of the Tpay service).
  3. An order paid online is processed once the payment has been credited. If payment is not made within 7 days of placing the order, the Seller may cancel the order.
  4. For every order the Seller issues a VAT invoice (including for a Consumer if no tax ID was given), sent electronically to the Customer’s e-mail address; by placing the order the Customer consents to this.

§ 7. Delivery

  1. Courier delivery is available within Poland. The Seller dispatches the parcel without delay, usually within 1–2 working days of the payment being credited.
  2. Packages delivered by the Seller’s transport arrive within 3–7 working days of the order, on a date agreed by phone. In the form the Customer can indicate that they will not be at the address and will leave the empty Bottles in a specified place, or that the water should be left with a specified neighbour.
  3. For a courier exchange the Customer prepares the empty Bottle for collection according to the instructions provided by the Seller: in an ordinary rectangular cardboard box, sealed with ordinary tape, with the label attached or the shipment number clearly written, ready to hand over to the courier on the agreed day.
  4. If the carrier charges the Seller an additional fee because the return parcel was not prepared according to the instructions (e.g. non-standard size, markings requiring special handling, parcel not ready on the agreed day), the Seller may charge the Customer this fee in the amount actually charged by the carrier, after informing the Customer in advance.
  5. The Customer should check the parcel on receipt. In case of damage it is recommended to write up a damage report with the carrier; this does not affect the Consumer’s rights in respect of non-conformity of the goods with the contract.

§ 8. Non-conformity of goods with the contract (complaints)

  1. The Seller is liable to the Consumer and the Entrepreneur with consumer rights for the conformity of goods with the contract under the Polish Consumer Rights Act of 30 May 2014.
  2. A complaint can be submitted by e-mail to zrodelkotako@gmail.com, by phone or in writing to the Seller’s address. It is recommended to give the order number, a description of the problem and, if possible, photos.
  3. The Seller responds to a complaint within 14 days of receiving it. If the complaint is accepted, the Seller replaces the goods with goods free of defects or refunds the amount due, in accordance with the law.
  4. Towards Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller’s liability under statutory warranty is excluded to the extent permitted by law; complaints are handled in good faith.

§ 9. Right of withdrawal

  1. The Consumer and the Entrepreneur with consumer rights may withdraw from a distance contract without giving a reason within 14 days of taking possession of the goods.
  2. The right of withdrawal does not apply to goods delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery (Art. 38(1)(5) of the Polish Consumer Rights Act). This applies to Bottles with a broken seal or an unscrewed cap.
  3. To withdraw from the contract, simply send a statement by e-mail or post, e.g. using the model form attached to these Terms.
  4. The Seller refunds all payments received, including the cost of the cheapest standard delivery, without delay and no later than 14 days of receiving the statement, using the same payment method unless the Customer agrees otherwise. The Seller may withhold the refund until the goods have been received back.
  5. The Customer sends the goods back within 14 days of withdrawal and bears the direct cost of returning them. At the Customer’s request the Seller can arrange a pickup – the cost will then be agreed with the Customer.
  6. The Customer is liable for any reduction in the value of the goods resulting from using them beyond what is necessary to establish their nature, characteristics and functioning.
  7. A bottle of water weighs about 20 kg, and the protective packaging (box, bubble wrap) is destroyed after the journey both ways and cannot be used again. In the case of a return, the refund is reduced by the cost of repacking the product in new protective packaging of PLN 15 gross per bottle.
  8. If the Customer does not collect the dispatched parcel (e.g. does not collect a parcel left for pickup) or refuses to accept an undamaged parcel, and the parcel returns to the Seller, the refund is reduced by the repacking cost (PLN 15 gross) and the cost of return shipping to the Seller (PLN 20 gross), i.e. by a total of PLN 35 gross per bottle.

§ 10. Out-of-court dispute resolution

The Consumer may use out-of-court methods of handling complaints and pursuing claims, e.g. the help of a district (municipal) consumer ombudsman or the provincial Trade Inspection office. Information is available at uokik.gov.pl.

§ 11. Personal data

The rules for processing personal data are described in the Privacy Policy.

§ 12. Final provisions

  1. The Seller may amend these Terms for important reasons, in particular changes in the law or in the scope of services. Orders placed before the change are governed by the Terms in force at the time the order was placed.
  2. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
  3. The provisions of these Terms do not limit Consumers’ rights under mandatory provisions of law.
